How long does it take to get divorce?
Answer:
Pennsylvania is a no-fault divorce state,
meaning that a party need not prove fault to
get divorced. This can dramatically speed
up the time it takes to get divorced. That
said, if one party opposes the divorce, then
the parties must live separate and apart for
two years before the divorce proceedings
can even begin! Technically, parties can live
"separate and apart" and still cohabitate so
long as they maintain separate finances and
they are generally not sexually intimate. The
courts realize that separated people
sometimes cohabitate as a matter of
convenience.
Then, once the two year period expires, it
takes approximately two months (allowing
extra time for administrative tasks) for the
parties to get divorced if there are no assets
to distribute.
If both parties consent to the divorce, there
is a 90 day cooling down period. Then, both
parties can file with the court proof that they
consent to the divorce and a divorce decree
will follow shortly thereafter so long as, once
again, there are no assets to distributes.
